Certification/Authentication/Attestation

Signing a document

​For use within England & Wales (and other parts of the UK):

​​You may be asked or required by a body, organisation or authority (governmental or otherwise) within this country to have documentation/information checked and/or witnessed by a third party before submission and for use within this country. The third party concerned is usually a person who, generally by virtue of regulation or convention, is classed as a 'public officer' or 'professional' who is granted the necessary authority.  There are a number of situations when this can arise are varied.  Examples include:

  • Certifying copies of UK personal documents (identification or otherwise) which are often requested for domestic employment, tenancy, or banking.  Additionally, for regulatory reasons such as FCA registration, SRA compliance or DBS Checks. 

  • Certifying copies of UK company documents typically for internal governance or UK-based compliance including Memorandum and articles of association, Minutes of meetings or Registers of directors or shareholders

  • Witnessing signatures on documents (where there is specific requirements or there is a preference for a 'professional' witness)  such as:

    • Powers of attorney for use within England and Wales

    • Deeds relating to property transactions

    • Shareholder or director resolutions for UK companies

There are usually other options for you, such as using the services of a solicitor and, in some situations, other 'professionals'.  The requirements of the person, body or organisation requiring the authentication or witnessing and the regulations they need to comply with will dictate this.  The capacity in which a notary acts varies but if the situation requires a 'notarial act' the same level of verification will be needed as it would be if it was for use abroad.  This is reflected in the fees charged.  Whether you are an individual, or somebody representing a company, business or other organisation  please contact us

​Some procedures are governed by particular regulation which prescribe particular wording not requiring notarial form, seal or protocol but rather as general legal certification.  Examples include:​​​​

  • As Certificate Provider for Lasting Powers of Attorney - to certify mental capacity and to ensure the donor understands what they are are signing.

  • Copies of Lasting Powers of Attorney which need to be certified in a specific way before acceptance by those relying on it.

  • Completion of Land Registry ID Forms for the purpose of land registration.

​Further situations will require notaries to act in their capacity as Commissioner for Oaths. where different procedures apply.
