As a Commissioners for Oaths
​The authority conferred by the Commissioners for Oaths Act 1889 (now covered in the definition of reserved legal activities (Schedule 2 of the Legal Services Act 2007) is limited to oaths and affidavits for the purpose of any court or matter in England and Wales. All notaries in England and Wales are, also, commissioners for oaths, which means they can administer affidavits (oaths sworn on a holy book or affirmed) and statutory declarations. The word “declarant” includes an affiant, deponent or anyone making an affidavit, declaration or sworn statement, and “declaration” also includes an affidavit, statutory declaration or any other document in which it is stated that a signatory has been duly sworn.

​If you choose to swear an oath (on a holy book) please let us know in advance which book you would like to swear on. An affirmation is regarded as equally binding as swearing on the declarer’s conscience. You may feel more comfortable doing this. Both are subject to the penalties of perjury.

These are notarial activities (rather than acts) but remain governed by the notary’s professional regulations. Where such document is to be used solely in England and Wales, our fee for this is based upon the current statutory rate which is £5.00, and £2.00 for each exhibit referred to.

As a Notary Public - oaths, affidavits, declarations, acknowledgements for use overseas
​These are notarial acts which are taken in the capacity as a notary public, sometimes involving the preparation of a notarial certificate. In certain jurisdictions, a sworn acknowledgment may form part of a document that has no other characteristics or features of an affidavit or declaration. Some common-law based overseas jurisdictions use the term ‘commissioner for oaths’ to refer to officers who are so appointed or authorised under their own laws. Whilst this title may be specifically printed on a document it does not mean that a notary in England and Wales can sign and seal the document in that capacity. ​​​Our fee for this will be based upon an hourly rate rather than the statutory rate.
